1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Aiviue Platform, including the website, web and mobile applications, WhatsApp-based conversational workflows, QR job application flows, the AI assistant "Aivi," employer dashboards, candidate tools, subscription services, and all related features and services provided by Aiviue Technologies Pvt. Limited ("Aiviue", "we", "us", or "our").

By accessing or using the Platform, you agree to be legally bound by these Terms, the Privacy Policy, the Refund Policy, and the Cancellation Policy. If you do not agree, you must immediately discontinue use of the Platform.

These Terms constitute a legally binding agreement between you and Aiviue.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements under applicable law. By using the Platform, you represent and warrant that you meet these requirements.

4. Scope of Services

Aiviue is an AI-powered hiring technology platform. The Platform enables candidates to create profiles, submit applications, upload resumes and video resumes, and interact with automated screening workflows. The Platform enables employers to create job descriptions, publish roles, receive applications, manage hiring pipelines, schedule interviews, and receive AI-generated summaries and workflow assistance.

Aiviue operates solely as a technology facilitator. Aiviue is not an employer, recruitment agency, staffing firm, background verification agency, or hiring decision-maker.

5. Nature of the Platform and No Hiring Guarantees

Aiviue does not verify the authenticity, accuracy, completeness, or legality of job postings, candidate profiles, resumes, video resumes, employer information, compensation details, or any user-submitted content.

Aiviue does not guarantee job placement, candidate selection, interview volume, hiring outcomes, time-to-hire, or employment results. All hiring decisions are solely the responsibility of employers.

Platform performance may vary based on market conditions, compensation competitiveness, employer responsiveness, geography, and external factors beyond Aiviue's control.

6. AI Assistant "Aivi" - Transparency and Limitations

Aivi provides automated summaries, screening insights, recommendations, and workflow assistance based on user-provided information and configured criteria.

AI outputs are informational only and non-binding. They must not be relied upon as verified assessments, factual determinations, or hiring decisions. Employers are solely responsible for independent review, verification, and final hiring decisions.

Aiviue is not liable for reliance on AI-generated outputs.

7. Account Registration and Security

Users must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and all activities conducted through your account. Aiviue is not liable for losses resulting from unauthorised account access caused by user negligence or misconduct.

8. Employer Responsibilities

Employers must ensure that all job postings, compensation details, requirements, video job descriptions, and related content are truthful, lawful, and associated with genuine hiring intent.

Employers must comply with all applicable labour laws, anti-discrimination laws, and employment regulations. Employers are solely responsible for screening, interviewing, evaluating, selecting, hiring, onboarding, and managing candidates.

Aiviue does not verify employer legitimacy or job authenticity and assumes no responsibility for employer compliance.

9. Candidate Responsibilities

Candidates must provide truthful, accurate, and complete information in profiles, resumes, video resumes, and communications. Candidates must not impersonate others, falsify information, or misrepresent qualifications.

Aiviue does not verify candidate credentials and assumes no responsibility for inaccuracies.

10. Prohibited Activities

Users may not misuse the Platform, including but not limited to posting false information, introducing malware, scraping data, reverse engineering systems, engaging in fraudulent hiring or application activity, impersonation, spamming, discriminatory conduct, or unlawful content distribution.

11. Content Ownership and License

Users retain ownership of content submitted to the Platform.

By using the Platform, users grant Aiviue a non-exclusive, worldwide, royalty-free license to store, process, analyze, display, and use such content for operating, improving, and maintaining the Platform, including use of de-identified data for AI model training as described in the Privacy Policy.

All Platform technology, software, AI systems, trademarks, branding, and intellectual property remain the exclusive property of Aiviue.

12. Payments, Subscriptions, and Billing

Employers purchasing paid plans agree to pay all applicable fees, taxes, and charges. Subscriptions may be recurring and automatically renew unless cancelled before the next billing cycle. All payments are governed by Aiviue's Refund Policy and Cancellation Policy.

Subscription fees, credits, add-ons, and usage-based charges are non-refundable unless expressly stated in the Refund Policy. Cancellation of a subscription does not entitle the subscriber to any refund or pro-rata refund for unused periods. Unused credits are non-refundable and non-transferable.

13. No Refund Guarantees

Aiviue does not provide full refund guarantees for subscription plans, credits, or platform usage. Refund eligibility, if any, is governed strictly by the Refund Policy and is subject to Aiviue's sole discretion.

14. Data Protection and Privacy

All personal data collection and processing is governed by the Aiviue Privacy Policy. By using the Platform, you consent to data practices described therein.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. Aiviue makes no warranties regarding uninterrupted operation, error-free performance, accuracy of content, authenticity of users, employment outcomes, or suitability for specific purposes.

16. Limitation of Liability

To the fullest extent permitted by law, Aiviue shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the Platform.

Aiviue shall not be liable for hiring decisions, employment disputes, compensation disagreements, reliance on AI outputs, misrepresentations by users, job posting inaccuracies, or employment-related claims. Your sole remedy for dissatisfaction is discontinuation of Platform use.

17. Indemnification

Users agree to indemnify and hold harmless Aiviue, its directors, officers, employees, and affiliates from any claims, liabilities, damages, or expenses arising from misuse of the Platform, violations of these Terms, disputes between users, or legal non-compliance.

18. Suspension and Termination

Aiviue may suspend or terminate accounts for violations of these Terms, fraudulent activity, payment disputes, chargebacks, misuse, or risks to Platform integrity. Termination does not entitle users to refunds.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

20. Changes to the Terms

Aiviue may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
